Please read these Terms and Conditions (“Terms”) carefully before using excarta.com (the “Site”), operated by ExCarta (“ExCarta,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

USE OF THE SITE
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable local, national, or international law or regulation
- Attempt to gain unauthorized access to the Site, our servers, or any systems or networks connected to the Site
- Interfere with or disrupt the security or proper functioning of the Site
- Use any automated means (bots, scrapers, crawlers) to access or collect data from the Site without our prior written consent
- Upload or transmit viruses, malware, or other harmful code
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Use the Site to transmit unsolicited advertising, spam, or other unauthorized communications
We reserve the right to restrict or terminate your access to the Site, at our sole discretion, if we believe you have violated these Terms.
SERVICES
The Site provides information about ExCarta’s strategic communications, branding, executive coaching, and related consultancy services. Nothing on the Site constitutes a binding offer to provide services. Any engagement for services is subject to a separate written agreement between ExCarta and the client, which will govern the scope, fees, and terms of that engagement.
If, now or in the future, the Site offers the ability to purchase products, book services, or make payments directly online, such transactions will be subject to additional terms presented to you at the time of purchase, which are incorporated into these Terms by reference.
1.No Medical, Psychological, Legal, or Financial Advice
ExCarta’s executive coaching, leadership development, and strategic communications consultancy services are intended for general professional development, communications strategy, and business purposes only. They do not constitute, and should not be relied upon as, medical, psychological, psychiatric, legal, or financial advice, diagnosis, or treatment. Coaching is not a substitute for therapy, counseling, or care from a licensed medical or mental health professional. If you are experiencing a medical or mental health concern, please consult a qualified healthcare provider.
2. No Guaranteed Results
Any case studies, testimonials, examples, or portfolio materials describing past coaching, communications, or consultancy engagements reflect specific past circumstances and are provided for illustrative purposes only. Coaching, consulting, and communications outcomes depend on numerous factors specific to each individual or organization, including factors outside ExCarta’s control. ExCarta does not guarantee any particular result, outcome, level of performance, career advancement, or business impact from its services, and no statement on the Site or by any ExCarta representative should be construed as such a guarantee.
INTELLECTUAL PROPERTY
1.ExCarta’s Content
The Site and all content on it, including, without limitation, text, graphics, logos, images, videos, case studies, portfolio materials, designs, and the overall look and feel of the Site (collectively, the “ExCarta Content”), are the property of ExCarta or our licensors and are protected by copyright, trademark, and other intellectual property laws.
Except as expressly permitted by these Terms or by applicable law, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any ExCarta Content without our prior written consent.
You may view and download a single copy of materials from the Site for your own personal, non-commercial use, provided you keep intact all copyright and other proprietary notices.
2. Third-Party Intellectual Property
The Site may reference, display, or link to trademarks, logos, trade names, copyrighted works, images, video footage, or other intellectual property belonging to our clients, partners, collaborators, or other third parties (“Third-Party IP”), including as part of our portfolio and case studies. All Third-Party IP remains the sole property of its respective owners. Its inclusion on the Site does not transfer any ownership or license rights to you, and does not imply any endorsement, sponsorship, or affiliation between ExCarta, the third-party owner, and any visitor to the Site, except as may be otherwise agreed in writing between ExCarta and the relevant third party.

3. Trademarks
“ExCarta,” the ExCarta logo, taglines and other marks used on the Site are trademarks of ExCarta. Other names, logos, and marks appearing on the Site may be the trademarks of their respective owners.
USER SUBMISSIONS
If you submit any information, feedback, or other content to us through the Site (for example, via our contact form), you grant ExCarta a non-exclusive, royalty-free, worldwide license to use that submission for the purpose of responding to you and operating our business, including internal record-keeping. You represent that you have the right to submit such information and that doing so does not violate any third party’s rights.
THIRD-PARTY LINKS AND SERVICES
The Site may contain links to third-party websites, platforms, or services (including social media platforms) that are not owned or controlled by ExCarta. We are not responsible for the content, accuracy, or practices of any third-party sites. Inclusion of a link does not imply endorsement by ExCarta. Your use of third-party sites is subject to their own terms and policies.
DISCLAIMERS
THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is complete, accurate, or current. Case studies, results, and portfolio materials describe past work and do not guarantee similar outcomes for any future engagement. As set out in Section 3 above, ExCarta’s coaching and consultancy services do not constitute medical, psychological, legal, or financial advice, and ExCarta makes no guarantee of any particular outcome from such services.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXCARTA AND ITS FOUNDERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless ExCarta and its founders, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your misuse of the Site.
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of Chile, without regard to its conflict-of-law principles, except where mandatory local consumer protection or data protection laws of your country of residence (including U.S. state law, Chilean law, or EU/UK law) require otherwise.
Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the competent courts of Santiago, Chile, except where applicable law grants you the right to bring a claim in your own jurisdiction of residence.
INTERNATIONAL USE
ExCarta operates internationally and the Site may be accessed from various countries, including the United States, Chile, and countries within the European Union and United Kingdom. We make no representation that the Site or its content is appropriate or available for use in all locations. If you access the Site from outside Chile, you do so on your own initiative and are responsible for compliance with local laws, to the extent local laws apply.
CHILDREN POLICY
The Site is intended for a general business and professional audience and is not directed to children under the age of 13. By using the Site, you represent that you are at least 13 years old, or the applicable age of digital consent in your jurisdiction. CHANGES TO THESE TERMS
We may revise these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and ExCarta regarding your use of the Site, and supersede any prior agreements regarding the same subject matter.
